Thomas Falcone is an associate with WWR’s litigation group. He has appeared before the Provincial Court of British Columbia, the Supreme Court of British Columbia, the Court of Appeal of British Columbia, and various administrative tribunals.
Thomas has a broad commercial and tax law barrister’s practice. He offers results-driven and cost-effective advocacy services including:
- General commercial litigation (contractual disputes, shareholder remedies and derivate actions, creditor and debtor issues, employment disputes);
- Tax litigation and dispute resolution (Notices of Objection, appeals to the Tax Court of Canada, judicial review of CRA taxpayer relief rejections);
- Administrative law (administrative appeals and judicial reviews);
- Legal opinions on discrete commercial, corporate, tax, or public law questions.
Thomas is especially interested in appellate advocacy, and is able to represent individuals and organizations appealing decisions made in federal or provincial level courts.
Prior to being called to the bar, Thomas worked for several years as a senior consultant at a “Big 4” professional services firm. He also worked as a consultant with the world’s largest corporate immigration law firm in Singapore and Malaysia.
Thomas maintains active involvement in the legal community and in public affairs. He is co-president of the Vancouver lawyer’s chapter of the Runnymede Society, a national law students’ and lawyers’ organizations dedicated to advancing the ideals of constitutionalism, freedom, and the rule of law. Previously, Thomas worked as the Runnymede Society’s national Communications Director and was co-president of the UBC chapter while in law school.
Having lived and worked in Korea, Singapore, and Malaysia, Thomas is interested in and frequently travels across the Asia-Pacific region. He is conversant in Japanese.

Lead counsel in an appeal successfully overturning a lower court decision to reduce an earlier ordered contempt of court fine.
Taheri v Hosseini 2023 BCSC 801
Junior counsel in a successful petition to bring a derivative commercial arbitration on behalf of a company for which the petitioner was a director. The company’s board of directors was deadlocked in a decision as to whether to bring an action against the limited partnership which it was the former general partner of for unpaid management fees. In allowing the petition, the Court found that the company’s other director was in a conflict of interest and that the petitioner had a better claim to the moral high-ground.

As lead counsel for a defendant, successfully secured the dismissal of a claim of contractual breach in a commercial dispute by arguing that the alleged ‘contract’ was a non-enforceable informal arrangement.

Junior counsel for the plaintiff collection agency in a successful action against a former client for payment of its close out fees, after the client requested CGI to close and return all collection files. The court awarded the plaintiff the full payment of its close-out fees.
